The products must also meet the U.S. requirements that apply to their category. A permit to operate does not establish whether a particular product is admissible.<\/p>\n<p dir=\"auto\" data-start=\"2631\" data-end=\"2964\">For an established importer, much of the work involves getting the details right on each shipment. The broker needs accurate product quantities and the information supporting the duty and excise-tax calculations. The importer also needs entry records it can reconcile with its reporting obligations after the cargo has been released.<\/p>\n<p dir=\"auto\" data-start=\"2966\" data-end=\"3345\">This guide focuses on commercial tobacco shipments, with particular attention to cigars and repeat imports. It does not cover travelers\u2019 allowances or personal tobacco purchases. That requirement covers cigars and cigarettes, as well as the smokeless, pipe, and roll-your-own tobacco categories defined in federal law.<\/p>\n<p dir=\"auto\" data-start=\"3704\" data-end=\"3897\">TTB does not charge an application fee. Fees charged by a professional for preparing an application are separate from the government\u2019s permit requirements.<\/p>\n<p dir=\"auto\" data-start=\"3899\" data-end=\"4093\">The importing business should be identified clearly in the permit and customs arrangements. Appointing a customs broker does not mean the broker\u2019s license replaces the tobacco importer\u2019s permit.<\/p>\n<p dir=\"auto\" data-start=\"4095\" data-end=\"4522\">For an existing business, review the permit\u2019s expiry date as well as its number. TTB states that importer permits expire five years after their effective date. Changes to the business can also require updated approval records. Its <a class=\"decorated-link\" href=\"https:\/\/www.ttb.gov\/business-central\/maintaining-compliance-in-the-tobacco-industry?utm_source=chatgpt.com\" target=\"_new\" rel=\"noopener\" data-start=\"4326\" data-end=\"4452\">guidance for existing tobacco importers<\/a> covers renewals and amendments.<\/p>\n<h3 dir=\"auto\" data-section-id=\"12iq8gu\" data-start=\"4524\" data-end=\"4573\">Processed Tobacco Has Its Own Permit Category<\/h3>\n<p dir=\"auto\" data-start=\"4575\" data-end=\"5027\">TTB has separate permit categories for finished tobacco products and processed tobacco. A business importing processed tobacco needs the relevant permit, although an existing tobacco-products importer permit can be amended to include that activity without obtaining a separate processed-tobacco permit. The <a class=\"decorated-link\" href=\"https:\/\/www.ttb.gov\/regulated-commodities\/tobacco\/permits?utm_source=chatgpt.com\" target=\"_new\" rel=\"noopener\" data-start=\"4882\" data-end=\"4964\">TTB permit categories<\/a> explain the distinction.<\/p>\n<p dir=\"auto\" data-start=\"5029\" data-end=\"5301\">Describe the goods precisely. Finished cigars and tobacco intended for further manufacturing should not be grouped together under an invoice description that says only \u201ctobacco.\u201d Raw leaf and other agricultural material need a separate review of their import requirements.<\/p>\n<h2 dir=\"auto\" data-section-id=\"15hqfv4\" data-start=\"5303\" data-end=\"5352\">FDA Requirements Depend on the Tobacco Product<\/h2>\n<p dir=\"auto\" data-start=\"5354\" data-end=\"5570\">For tobacco products within FDA\u2019s authority, the agency checks matters including market authorization, labeling, and user-fee compliance at importation. The relevant FDA office is the <strong data-start=\"5538\" data-end=\"5569\">Center for Tobacco Products<\/strong>.<\/p>\n<p dir=\"auto\" data-start=\"5572\" data-end=\"6159\">A new tobacco product subject to FDA\u2019s premarket rules generally needs an appropriate marketing order before it can lawfully enter the U.S. market. The definition of a new product includes products not commercially marketed in the United States as of February 15, 2007, and certain later modifications. Evidence supporting an older product\u2019s status needs to concern the actual product, not simply the age of the brand. See FDA\u2019s <a class=\"decorated-link\" href=\"https:\/\/www.fda.gov\/industry\/importing-fda-regulated-products\/importing-tobacco-products?utm_source=chatgpt.com\" target=\"_new\" rel=\"noopener\" data-start=\"6001\" data-end=\"6120\">tobacco import requirements<\/a>.<\/p>\n<p dir=\"auto\" data-start=\"6161\" data-end=\"6320\">Premium cigars have a separate position following the court decisions discussed below. Do not apply the same FDA conclusion to every cigar in a mixed shipment.<\/p>\n<h3 dir=\"auto\" data-section-id=\"q6za58\" data-start=\"6322\" data-end=\"6376\">Does Every Tobacco Importer Need FDA Registration?<\/h3>\n<p dir=\"auto\" data-start=\"6378\" data-end=\"6698\">No. FDA states that importers who do not own or operate a domestic establishment engaged in manufacturing, preparing, compounding, or processing a tobacco product do not have to register that establishment or submit product listings. They must still meet the other requirements that apply to their business and products.<\/p>\n<p dir=\"auto\" data-start=\"6700\" data-end=\"7099\">The distinction appears in <a class=\"decorated-link\" href=\"https:\/\/www.fda.gov\/tobacco-products\/products-guidance-regulations\/importing-and-exporting?utm_source=chatgpt.com\" target=\"_new\" rel=\"noopener\" data-start=\"6727\" data-end=\"6857\">FDA\u2019s guidance for tobacco importers<\/a>. Establishment registration and product authorization are different questions. A registration number supplied by a manufacturer does not, by itself, establish that every product it makes can be imported.<\/p>\n<h2 dir=\"auto\" data-section-id=\"s95yyx\" data-start=\"7101\" data-end=\"7153\">What Is Different About Importing Premium Cigars?<\/h2>\n<p dir=\"auto\" data-start=\"7155\" data-end=\"7414\">A federal court set aside FDA\u2019s 2016 Deeming Rule as it applied to qualifying premium cigars. Retain the manufacturer\u2019s specifications and an explanation of how the product meets the definition.<\/p>\n<p dir=\"auto\" data-start=\"8429\" data-end=\"8773\">This treatment does not remove TTB permit or federal excise-tax obligations. It also should not be confused with the tax definition of a <strong data-start=\"8566\" data-end=\"8581\">large cigar<\/strong>, which uses a threshold of more than three pounds per 1,000 cigars. The tax category and the court\u2019s premium-cigar category answer different questions.<\/p>\n<p dir=\"auto\" data-start=\"8775\" data-end=\"8973\">For a shipment containing both qualifying premium cigars and other cigars, keep the products separately identifiable in the supporting records. The FDA treatment needs to follow the actual products.<\/p>\n<h2 dir=\"auto\" data-section-id=\"1r9u6e9\" data-start=\"8975\" data-end=\"9025\">Review the Packaging Before the Shipment Leaves<\/h2>\n<p dir=\"auto\" data-start=\"9027\" data-end=\"9189\">The labeling rules are product-specific. A package for cigarettes, smokeless tobacco, or cigars should not be reviewed against a single generic tobacco checklist.<\/p>\n<p dir=\"auto\" data-start=\"9191\" data-end=\"9651\">Older guidance can be misleading here. FDA confirms that the federal health-warning requirements for cigars and pipe tobacco in 21 CFR \u00a7\u00a7 1143.3 and 1143.5 were <a class=\"decorated-link\" href=\"https:\/\/www.fda.gov\/tobacco-products\/products-ingredients-components\/cigars-cigarillos-little-filtered-cigars?utm_source=chatgpt.com\" target=\"_new\" rel=\"noopener\" data-start=\"9352\" data-end=\"9503\">set aside by a court in September 2020<\/a>. That does not remove other packaging requirements or the separate rules covering other tobacco categories.<\/p>\n<p dir=\"auto\" data-start=\"9653\" data-end=\"9826\">Have the final artwork reviewed for the particular product. Include the packaging that will actually arrive, rather than an earlier design from the manufacturer\u2019s catalogue.<\/p>\n<h3 dir=\"auto\" data-section-id=\"1y8e7qe\" data-start=\"9828\" data-end=\"9857\">Country-of-Origin Marking<\/h3>\n<p dir=\"auto\" data-start=\"9859\" data-end=\"10170\">CBP generally requires imported goods or their permitted containers to identify the country of origin in English, subject to the relevant exceptions. The <a class=\"decorated-link\" href=\"https:\/\/www.law.cornell.edu\/cfr\/text\/19\/134.11\" target=\"_new\" rel=\"noopener\" data-start=\"10013\" data-end=\"10094\">country-of-origin marking rules<\/a> apply separately from FDA labeling.<\/p>\n<p dir=\"auto\" data-start=\"10172\" data-end=\"10338\">The country shown on an invoice does not replace a required marking on the goods or packaging. Keep the origin information consistent with the manufacturer\u2019s records.<\/p>\n<h2 dir=\"auto\" data-section-id=\"126mllh\" data-start=\"10340\" data-end=\"10389\">Customs Duty and Federal Excise Tax on Tobacco<\/h2>\n<p dir=\"auto\" data-start=\"10391\" data-end=\"10656\">Customs duty and federal tobacco excise tax are separate charges. The duty depends on the correct Harmonized Tariff Schedule classification and the treatment that applies to the goods and their origin. The excise-tax calculation depends on the tobacco tax category.<\/p>\n<p dir=\"auto\" data-start=\"10658\" data-end=\"10901\">The <a class=\"decorated-link\" href=\"https:\/\/hts.usitc.gov\/\" target=\"_new\" rel=\"noopener\" data-start=\"10662\" data-end=\"10719\">U.S. Harmonized Tariff Schedule<\/a> is the starting point for duty classification. Customs duties, processing fees, brokerage, and any state taxes must be considered separately.<\/p>\n<h3 dir=\"auto\" data-section-id=\"1njajim\" data-start=\"11646\" data-end=\"11699\">Which Price Is Used to Tax Imported Large Cigars?<\/h3>\n<p dir=\"auto\" data-start=\"11701\" data-end=\"11940\">For large cigars, the relevant sale price is generally the price at which the importer sells the packaged cigars in an arm\u2019s-length transaction to an unrelated purchaser. <strong data-start=\"11872\" data-end=\"11940\">It is not generally the price paid to the overseas manufacturer.<\/strong><\/p>\n<p dir=\"auto\" data-start=\"11942\" data-end=\"12263\">TTB explains this in its <a class=\"decorated-link\" href=\"https:\/\/www.ttb.gov\/public-information\/industry-circulars\/archives\/2011\/11-03?utm_source=chatgpt.com\" target=\"_new\" rel=\"noopener\" data-start=\"11967\" data-end=\"12100\">guidance on calculating tax on imported large cigars<\/a>. Special valuation rules can apply to retail sales, related-party transactions, and other arrangements that do not follow an ordinary arm\u2019s-length wholesale sale.<\/p>\n<p dir=\"auto\" data-start=\"12265\" data-end=\"12594\">The tax liability can arise when the goods leave customs custody, before the importer has completed a sale. Establish the appropriate tax value with the broker and tax adviser rather than treating the foreign commercial invoice as the answer to both customs valuation and cigar excise tax.<\/p>\n<p dir=\"auto\" data-start=\"12596\" data-end=\"12880\">For ordinary tax-paid imports, CBP collects the tobacco excise tax under the <a class=\"decorated-link\" href=\"https:\/\/www.law.cornell.edu\/cfr\/text\/27\/41.62\" target=\"_new\" rel=\"noopener\" data-start=\"12673\" data-end=\"12751\">customs collection provisions<\/a>. Confirm that the government-charge breakdown separates duty and excise tax.<\/p>\n<h2 dir=\"auto\" data-section-id=\"ld5u2p\" data-start=\"12882\" data-end=\"12929\">What Documents Does the Customs Broker Need?<\/h2>\n<p dir=\"auto\" data-start=\"12931\" data-end=\"13200\">The broker needs the commercial documents and enough product information to determine how to enter the shipment.
