Before shipment, the broker needs to know exactly what the food is, where it was produced, and which business is importing it.

Food imports also require a review of the product and manufacturer requirements. For foods regulated by the Food and Drug Administration, or FDA, this can include facility registration, Prior Notice, and identifying the party responsible for foreign supplier verification.

A1 Worldwide Logistics provides US customs brokerage and freight services for commercial imports. Send our team your product list and proposed shipping details so we can review the customs work required and prepare a quote.

What a Customs Broker Does for a Food Shipment

The broker uses the shipment documents to prepare the customs entry, including the tariff classification and declared value, and arrange the applicable duty payment. For FDA-regulated food, the entry also needs the required FDA information about the product and the parties involved in the shipment.

A broker can transmit that information and supporting documents through the FDA entry submission process. The importer needs to supply accurate records and ensure the food meets US requirements. The manufacturer’s registration and the food-safety work required of the importer need to be addressed before the goods arrive.

Explain whether you need customs clearance only or also want help arranging freight and delivery. If a supplier has booked the transport, provide the booking details and the name of the forwarder handling it.

Documents and Product Information to Prepare

Provide information for each product in the shipment. A mixed order of food products needs enough detail for the broker to assess each item.

Document or information

What to provide

Commercial invoice

The buyer and seller, clear product descriptions, quantities, values, currency, and country of origin.

Product specifications and labels

The ingredients, processing details, pack sizes, and clear copies of all label panels. Explain whether the food is packaged for retail sale or supplied as an ingredient.

Manufacturer information

The actual manufacturer’s name and address, plus current FDA facility registration information when required.

Importer information

The customs importer’s legal business details and importer number. Identify the business responsible for foreign supplier verification when the food is subject to those rules.

Packing and transport documents

The packing list, bill of lading or air waybill, and expected arrival details. Include the arrival notice once issued.

Product-specific records

Permits or processing records required for the food. For covered acidified or low-acid canned foods, obtain the processor’s registration and product process-filing details.

Storage and delivery instructions

The final delivery address, required storage temperature, and any handling or shelf-life limits the transport provider needs to know.

If this is your first import, the broker will also confirm the importer setup, power of attorney, and customs bond requirements. A1’s guide to documents for customs clearance explains the general shipment paperwork.

Check the Food and Its Country of Origin Before Booking

For fresh produce and certain other agricultural products, check APHIS requirements for the commodity and country of origin. Tell the broker how the food has been processed, as the requirements for a fresh product can differ from those for a processed ingredient.

Meat, poultry, and egg products regulated by USDA’s Food Safety and Inspection Service need a separate import review. Identify animal ingredients in prepared foods so the correct agency requirements can be checked.

For FDA-regulated products, the manufacturing process can also create additional requirements. FDA checks the processor’s registration and the process filed for covered acidified and low-acid canned foods. Have the actual formulation and processing information reviewed before assuming that a canned or bottled product meets those requirements.

FDA Food Facility Registration

Facilities that manufacture, process, pack, or hold food for US consumption generally need to register with FDA, unless an exemption applies. Confirm which facilities in your supply chain require registration and obtain their current information.

A foreign facility that must register also needs a US agent for FDA communications. Ask the manufacturer who holds that role. The agent’s responsibilities for the facility’s registration are separate from the foreign supplier verification responsibilities explained below.

If a supplier describes its food as “FDA approved,” ask for the actual registration and product records supporting the shipment. FDA does not generally preapprove conventional food products or their labels. The food still needs to meet US requirements.

Identify the FSVP Importer Before Shipping

The Foreign Supplier Verification Programs, or FSVP, rules require covered importers to verify their foreign suppliers’ food-safety practices. FSVP involves documented work on the food and supplier, so the responsible party needs to be established before shipment.

For food subject to FSVP, the importer is the US owner or consignee at the time of entry. This includes a US person who owns the food, has purchased it, or has agreed in writing to purchase it. If there is no US owner or consignee, a US agent or representative of the foreign owner or consignee must consent in a signed statement to serve as the FSVP importer.

The FSVP importer can be different from the customs importer of record and the foreign facility’s FDA registration agent. Confirm who is taking each role. Appointing a broker to file the customs entry does not automatically make that broker responsible for FSVP.

For entry lines subject to FSVP, give the broker the FSVP importer’s name, email address, and FDA-recognized unique facility identifier. FDA currently recognizes the DUNS number for this purpose. Exemptions and modified requirements apply to some foods and importers, so the review needs to address the actual product.

Have the Labels Reviewed Before Export

Confirm who is checking the labels for US compliance, and give the broker clear copies of all label panels and the ingredient list before shipment. The review should cover the required ingredient and allergen declarations and the nutrition-labeling requirements for that product.

Required label information generally needs to appear in English. Review the label for the intended US market, including any requirements that apply when another language is also used.

Use the final label and product information for the shipment. If the supplier changes the recipe, manufacturer, or packaging after the initial review, send the updated records to the broker before filing.

Arrange FDA Prior Notice and Any Ocean ISF Filing

Food subject to FDA Prior Notice must have the notice submitted and confirmed by FDA for review within the required timeframe. The minimum is four hours before arrival for air freight and eight hours for water arrivals. Other arrival methods have their own deadlines.

Agree who will submit the notice and obtain the confirmation once it has been filed. Provide the manufacturer and product details early enough for the filing to be prepared before the deadline.

For containerized ocean imports entering US commerce, the first eight Importer Security Filing, or ISF, data elements are generally due at least 24 hours before vessel loading at the foreign port. FDA Prior Notice and ISF are separate filings with different deadlines. Confirm who is handling each one. A1’s ISF filing guide explains the ocean-freight requirements.

Customs Brokerage Costs and Delivery

Request a quote using the actual product list, shipment value, and expected arrival port. A mixed food shipment may require different classifications and duty calculations for its individual products.

Ask for the brokerage fee and estimated duties to appear separately. Confirm whether the quote includes the required FDA entry work and Prior Notice, and whether ocean ISF filing is included when needed. For any separate FSVP or specialist regulatory work, identify the provider and agree the scope.

If delivery is required, provide the destination and the food’s storage requirements before booking transport. Confirm who will arrange suitable storage if the shipment is awaiting review and which charges may remain payable separately. Examination or storage charges may arise after arrival.

For repeat imports, tell the broker how often you expect shipments and whether the suppliers and products will remain the same. This allows the quote and account setup to reflect the work you are planning.

If the Food Has Already Shipped or Is Awaiting Release

Send A1 the shipping documents, expected arrival date, and any entry or Prior Notice confirmation already issued. Explain where the food is being held and whether another broker has submitted an entry.

If FDA has issued a Notice of FDA Action, send the full notice and any response already submitted. Include any stated response deadline. The team needs the shipment’s actual status and FDA’s instructions to assess the work required.

For FDA-regulated food, have the broker confirm FDA status and customs release before distribution. Food awaiting FDA’s admissibility decision must not be distributed into US commerce. Any movement to storage must also respect the shipment’s release conditions.

Discuss Your Commercial Food Import With A1

A1 Worldwide Logistics can review the customs brokerage and freight arrangements for your proposed food shipment.
