Class Action For IEEPA Refunds

The Court of International Trade (CIT) has recently announced a class action for IEEPA refunds. On October 8, the CIT said the class action will allow refunds to importers who imported cargo under the now-illegal International Emergency Economic Powers Act (IEEPA) tariffs. The Trump Administration originally announced the tariffs in 2025, citing trade deficits and the inflow of illegal drugs. In February 2026, the Supreme Court ruled that the IEEPA levies were illegal. Following the ruling, the Court of International Trade (CIT) ordered CBP to refund all importers who paid IEEPA tariffs. With over $166 billion already refunded, the class action could allow the remaining importers to recover their funds.

Why Did The CIT Announce The Class Action?

Along with allowing for additional refunds, the class action will allow refunds for importers that did not file individual lawsuits. After the Supreme Court ruled that the IEEPA tariffs were illegal, only importers filing lawsuits with the CIT were refunded. Next, importers that filed claims under the Consolidated Administration and Processing of Entries (CAPE) system were allowed refunds. Smaller and non-filing importers could be eligible for refunds without filing thousands of separate lawsuits. The class action will account for importers who paid IEEPA duties between February 1, 2025, and February 19, 2026. No mechanisms for disbursements are currently announced by the CIT; however, future conferences have been scheduled.

What Could the Class Action For IEEPA Refunds Mean For Shipping?

The class action could allow importers impacted by the IEEPA tariff a shared legal path to receiving refunds. This will make it easier for individuals and businesses that lack experience navigating the CAPE portal. Smaller importers that may lack the financial resources to file a lawsuit may also benefit. Importers that filed a separate lawsuit with the CIT will not be included in the class action. Despite the announcement, refunds may not be disbursed immediately, as the federal government may appeal. Importers should continue to monitor the situation and take the appropriate action as developments arise.

When shipping goods internationally, various regulations can impact the shipment’s success. Whether positive or negative, you need to understand these regulations and what they mean for your cargo. While this can be done by doing research, it can also be done by speaking to a customs broker. Customs brokers are licensed corporations, partnerships, and private individuals who arrange customs clearance for importers. In the US, they ensure compliance with Customs and Border Protection (CBP) regulations. Brokers do this by offering solutions including calculating duties, filing entries, providing paperwork, and more.
